Suing NSA for Data Breach Close to Impossible, Lawyers Say

While it was revealed that the recent massive cyber attacks was launched using NSA tools, lawyers agree that it would extremely difficult, if not impossible, for victims to sue the US agency.

Former assistant U.S. attorney and of counsel at Carlton Fields, Joe Swanson says the lawsuit could be filed but doubts it will go anywhere. From the sovereign immunity doctrine to NSA’s secretive nature, it will be difficult to prove the agency’s negligence that may have caused the tools to fall into the hacker’s hands.

Swanson suggested that the best step the victims can take is to review their own vulnerabilities and to not be complacent with cyber security.
