20 Jan Shyam Divan: Indian Citizens Pressured to Give Up Sensitive Information
Earlier this week, Senior counsel Shyam Divan argued to the five-judge Constitution Bench that the Aadhaar project is compelling citizens to share their sensitive personal data with private bodies. According to Divan, this is already in violation of fundamental rights, including the right to privacy.
Divan pointed out that the Aadhaar had issues with the integrity of the data collection process and the information collected, and added that there was a pervasive violation of fundamental rights.
Divan even showed the court that the Aadhaar Enrollment Form, as it existed before the Aadhaar Act 2016, does not say that enrollment in the program was voluntary, and does not even mention that providing biometric information was required.
