The ruling against a small French adtech firm Vectaury is said to set a precedent throughout Europe as it may signal the end of intrusive online ads.
According to a tweet by Robin Berjon, consent through the IABEurope framework is invalid since CNIL had ruled that consent cannot be passed onto another controller through a contractual relationship. Consent under the GDPR must be specific, informed and freely given, says the French data watchdog.
Given this, businesses can no longer simply tuck consent inside a contractual “carpet-bag” that gets passed around to others in their chain as soon as the user provides their consent.
