EU Decides on Data Rules Governing Facebook Fan Page Owners

The European Court of Justice recently ruled that Fan Page Administrators, alongside Facebook, are jointly responsible as data controllers for the processing of users’ personal data on their Business Fan Pages.

In a case referred by the Federal Administrative Court, the CJEU decided that since page admins determine the parameters for data collection and receive data on fan profiles from Facebook, they are to be considered as data controllers, and are jointly responsible with Facebook for compliance with data protection law.

The CJEU also said that because Facebook had a subsidiary in Germany which deals with the company’s ad system and data processing activities, the local DPA was qualified to to intervene.
