08 Sep Brazilian Subway Operator Sued for Unauthorized Passenger Data Collection
Sao Paulo subway operator ViaQuatro was sued by Brazilian Institute of Consumer Protection (IDEC) for collecting the data of its passengers.
The civil lawsuit says that the operator used a technology that collected and displayed details such as emotions, approximate age and gender from its passengers without giving them any choice on the matter.
IDEC lawyer and digital rights expert, Rafael Zanatta said that not only is the case overwhelming in magnitude, the initiative in itself was abusive as since public transport is an essential service and passengers were forced with a choice to either give up their privacy, or look for another mode of transportation. He added that it was in violation of the Constitution, in addition to various federal laws.
