India’s Supreme Court: Aadhaar is Government’s Right to Citizen Information

Last Tuesday, Justice DY Chandrachud said that “mere possibility of misuse will not lead to striking down a legislation”.

As one of the Supreme Court’s five-judge bench hearing the Aadhaar privacy case brought by senior lawyer Kapil Sibal, Justice Chandrachud questioned the level of acceptable risk in the absence of technologically assured safe environment and added that for the court to strike down a law, one must establish that the legislation is colourable and arbitrary.

Mr. Sibal responded that even if the state has no intentions to misuse a citizen’s data, it can still be misused by private players once the data becomes available in the public domain.
