02 May Facebook Appeals to Keep Data Privacy Case Off EU Top Court
Facebook had reportedly made a last ditch effort to block the referral of its Irish privacy case to the European Court of Justice to avoid a ban on the legal instrument that allows the company to send user data back to the US.
It is said that a decision on the Max Schrems case by the ECJ could cause massive problems for thousands of companies that make millions of such transfers daily.
Facebook lawyer Paul Gallagher said that they had asked for the referral to be delayed as they are waiting for the Irish court’s decision on their appeal. However, Ireland’s Data Protection Commissioner said that there was no precedent for the appeal and it would just delay the question while millions of people’s data are being transferred to the United States each day.
