04 Oct EU Top Court Will Rule on EU-US Data Transfer Case
Last Tuesday, the task of ruling on a data handling case filed by a privacy activist was passed by Ireland’s High Court to the European Court of Justice.
In referring the case to the EU court, Irish High Court Judge Caroline Costello said that the data of EU citizens should be given the same high level protection EU law provides it in the countries where it is transferred to. She added that the Irish Data Commissioner pointed out that US law lacks a compatible requirement found in Article 47 of the Charter of Fundamental Rights.
Facebook issued a reply, saying that the EU court should first look at evidence showing robust protection already in place under the Standard Contractual Clauses (SCCs) and U.S. law.
